Terms of Use

Last updated: March 2026

These Terms of Use (hereinafter "ToU") govern the use of the Capsul service (hereinafter "the Service"), accessible at capsul.app and through associated applications, published by Sébastien Gonin, Sole Proprietorship (hereinafter "the Publisher"). By accessing or using the Service, the user (hereinafter "the User") accepts these ToU without reservation. If the User does not accept these terms, they must refrain from using the Service.

Article 1 — Purpose of the Service

The Capsul Service allows its Users to create time-locked messages (hereinafter "Capsuls") intended to be opened at a future date determined by the sender. The Service offers 1 free capsul upon registration, and paid credit packs offering additional capsuls and advanced features. The terms relating to pack purchases are detailed in the Terms of Sale.

Article 2 — Acceptance of the Terms of Use

Use of the Service is subject to the full and unconditional acceptance of these ToU. This acceptance is evidenced by the creation of an account or the use of the Service. The Publisher reserves the right to modify these ToU at any time. Users will be informed of any substantial modifications by email or notification within the Service. Continued use of the Service after modification constitutes acceptance of the new ToU.

Article 3 — Account Creation and Authentication

Access to the Service requires the creation of an account. Registration is done via Google OAuth or by magic link sent by email. The User agrees to provide accurate and up-to-date information during registration. Each account is personal and may not be shared or transferred to a third party. The User is responsible for the confidentiality of their access credentials and for any use made of their account. In the event of unauthorized use of their account, the User must inform the Publisher without delay at la.fabrique.des.reves06@gmail.com.

Article 4 — User Obligations

The User agrees to use the Service in accordance with these ToU, applicable laws and regulations, and the rights of third parties. The User specifically agrees not to:

  • Publish, distribute, or transmit any content that is unlawful, defamatory, insulting, obscene, pornographic, violent, inciting racial, ethnic, or religious hatred, or infringing on the privacy of others
  • Use the Service for harassment, threats, or intimidation purposes
  • Transmit any content containing viruses, trojan horses, or any other malicious software
  • Infringe on the intellectual property rights of third parties
  • Use the Service for unauthorized commercial purposes or spam
  • Attempt to circumvent the Service's security measures or access other Users' data
  • Use automated systems (bots, scripts, etc.) to interact with the Service without prior authorization

The Publisher reserves the right to remove any content that violates these ToU without notice or compensation.

Article 5 — How Capsuls Work

The Service is based on the principle of capsul immutability: once sealed, a Capsul cannot be modified, deleted, or viewed before its opening date. This principle is an essential element of the Service accepted by the User.

The User is solely responsible for the content they place in their Capsuls. The Publisher does not exercise any prior editorial control over Capsul content. However, the Publisher reserves the right to remove any Capsul whose content is manifestly unlawful, in accordance with applicable laws.

Each registration offers 1 free capsul with 1 recipient and a maximum duration of 6 months. Paid packs (Discovery, Essential, Prestige) offer additional credits, more recipients per capsul and extended durations up to 50 years.

Article 6 — Intellectual Property

All elements of the Service (interface, design, source code, Capsul brand, logo, texts) are protected by intellectual property law and are the exclusive property of the Publisher.

The User retains all intellectual property rights to the content they create and place in their Capsuls. By using the Service, the User grants the Publisher a limited, non-exclusive, and revocable license to store, process, and transmit such content solely for the purpose of providing the Service.

Article 7 — Limitation of Liability

The Service is provided "as is" and "as available." The Publisher strives to ensure the availability and reliability of the Service but does not guarantee uninterrupted operation, free from errors or security vulnerabilities.

The Publisher shall not be held liable for any direct or indirect damages resulting from the use or inability to use the Service, including loss of data, loss of Capsuls, or damages caused by content published by Users.

The Publisher cannot be held responsible for content created by Users or for the consequences of opening a Capsul on its recipients. The User assumes full responsibility for the content of their Capsuls and their consequences.

Article 8 — Account Suspension and Termination

The User may delete their account at any time by contacting the Publisher at la.fabrique.des.reves06@gmail.com. Account deletion results in the permanent deletion of the User's personal data, in accordance with our Privacy Policy. Capsuls already sealed and sent to third parties remain accessible until their opening date.

The Publisher reserves the right to suspend or terminate any User's account in the event of a violation of these ToU, without notice or compensation. In the event of termination for breach, the User shall not be entitled to any refund.

Article 9 — Applicable Law and Jurisdiction

These ToU are governed by French law. In the event of a dispute, the User is invited to contact the Publisher in order to seek an amicable solution. Failing this, a consumer User may refer the matter free of charge to the consumer mediator under the conditions set out in Article 8 of the Terms and Conditions of Sale, or bring proceedings, at their choice, before any court with territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where they resided at the time the contract was concluded or the harmful event occurred (Article R.631-3 of the French Consumer Code).

Article 10 — Modification of the Terms of Use

The Publisher reserves the right to modify these ToU at any time. Modifications shall take effect upon publication on the Service. The User will be informed of any substantial modification by email or notification. Continued use of the Service after publication of modifications constitutes acceptance of the new ToU. In case of disagreement with the modifications, the User must cease using the Service and delete their account.

Article 11 — Miscellaneous Provisions

If any provision of these ToU is declared null or unenforceable, the remaining provisions shall remain in full force and effect.

The Publisher's failure to exercise any provision of these ToU shall not constitute a waiver of the right to exercise such provision at a later date.
