Terms of Sale
Last updated: October 2026
These Terms of Sale (hereinafter “ToS”) govern the contractual relationship between Sébastien Gonin, Sole Proprietorship, SIRET 911 087 591 00010 (hereinafter “the Provider”) and any user purchasing a capsül credit pack or a duration extension on the Capsül Service (hereinafter “the Customer”). Any purchase implies full and unconditional acceptance of these ToS, the Terms of Use (ToU) and the Privacy Policy.
Article 1 — Purpose
These ToS define the conditions under which the Provider supplies the Customer with capsül credit packs and duration extensions. Three packs are available: Discovery (5 capsüls, €2.99), Essential (15 capsüls, €6.99) and Prestige (50 capsüls, €14.99). Each pack grants credits and unlocks higher usage limits: number of recipients, maximum scheduling duration and number of photos. Duration extensions, sold separately, allow a capsül to be scheduled beyond the duration included in the Prestige pack.
Article 2 — Pricing and Payment
Packs are offered at the following prices, in euros inclusive of all taxes: Discovery Pack €2.99, Essential Pack €6.99, Prestige Pack €14.99. Purchases are one-time payments, with no commitment, no renewal and no subscription. The Provider reserves the right to modify its prices at any time; the applicable prices are those displayed at the time of the order.
Payment is made by credit card through the secure payment platform Stripe (Stripe, Inc.). The Provider never has access to the Customer's complete banking information, which is processed directly by Stripe in compliance with PCI-DSS standards.
Duration extensions are offered at the uniform rate of €1.00 per additional year, in bundles of 5 years (€5.00), 15 years (€15.00) and 40 years (€40.00). Like packs, they are subject to a one-time payment.
Article 3 — Credits, Limits and Duration Extensions
Capsül credits acquired through the purchase of a pack are added to the Customer's balance. Credits are cumulative and do not expire. Each capsül creation consumes one credit.
The highest pack ever purchased by the Customer determines their usage limits, which are permanently acquired: without any purchase, 1 recipient, a maximum scheduling period of 180 days and no attachments; Discovery pack, 3 recipients, 1 year and 1 photo; Essential pack, 5 recipients, 5 years and 1 photo; Prestige pack, unlimited recipients, 10 years and 3 photos. Only photos are accepted as attachments: the Service allows neither the upload nor the storage of video or audio files.
The Customer may acquire duration extensions in order to schedule a capsül beyond ten years. Extensions are cumulative up to a limit of forty additional years, bringing the maximum scheduling duration to fifty years. They are attached to the Customer's account and must be acquired before the creation of the capsül concerned.
Article 4 — Right of Withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer who qualifies as a consumer has a period of fourteen days from the conclusion of the contract to exercise their right of withdrawal, without having to justify their decision or incur any penalties.
However, in accordance with Article L.221-28 13° of the French Consumer Code, this right may not be exercised for the supply of digital content not supplied on a tangible medium where performance has begun after the Customer's prior express consent and express waiver of their right of withdrawal. At the time of purchase, the Customer is invited to expressly request immediate performance of the service and to acknowledge that they lose their right of withdrawal over the credits and extensions actually used. This consent is collected and time-stamped.
As a commercial gesture, the Provider agrees to refund unused credits and extensions for fourteen days from the purchase; credits consumed by the creation of a capsül and extensions attached to a created capsül are not refundable. To exercise their right of withdrawal, the Customer shall send a clear statement by email to la.fabrique.des.reves06@gmail.com. The refund is issued within fourteen days of receipt of the request, using the same payment method as the one used for the purchase.
Article 5 — Refund Policy
Outside the right of withdrawal defined in Article 4, amounts paid for the purchase of packs and extensions are not refundable. As credits are not subject to any expiry, they remain usable without any time limit.
In the event of a malfunction of the Service attributable to the Provider that prevented the creation or the delivery of a capsül, the Customer may request the restitution of the consumed credit or, failing that, the refund of the corresponding amount. Any request shall be sent to la.fabrique.des.reves06@gmail.com.
Article 6 — Modification of the Service and Pricing
The Provider reserves the right to evolve pack features and pricing. Credits and extensions already acquired remain usable under the conditions in effect at the time of their purchase.
In the event of a substantial modification unfavourable to the Customer, credits and extensions already acquired retain their value and the usage limits linked to the highest pack purchased remain permanently acquired.
Article 7 — Liability
The Provider undertakes to provide the Service with diligence, in accordance with industry practice. This constitutes an obligation of means, not of result. The Service may be interrupted or permanently discontinued, in particular for technical, economic or regulatory reasons; in such a case, the Provider shall endeavour to inform the Customer within a reasonable period. The Provider is liable for damage caused to the consumer Customer under the conditions provided for by law: no provision of these ToS limits or excludes such liability. With respect to Customers acting for professional purposes, the Provider's liability is limited to the total amount paid in respect of their purchases on the Service.
Article 8 — Consumer Protection
In accordance with European Directive 2011/83/EU on consumer rights and applicable consumer protection laws, the Customer benefits from all protections provided by European legislation regarding electronic commerce.
The Provider is subject to the legal guarantee of conformity for digital content and digital services provided for in Articles L.224-25-12 et seq. of the French Consumer Code. The Customer may invoke it in the event of a lack of conformity of the Service, without prejudice to the other applicable legal guarantees.
In accordance with Article L.612-1 of the French Consumer Code, the Customer may resort free of charge to a consumer mediator with a view to the amicable resolution of a dispute. For cross-border disputes within the European Union, the Customer may contact the European Consumer Centres Network.
Article 9 — Personal Data
Personal data collected in connection with the purchase and management of packs and extensions are processed in accordance with our Privacy Policy. Payment data are processed exclusively by Stripe and are never stored on our servers. Proof of the consent referred to in Article 4, including the date and time of its collection, is retained for five years from the purchase, in accordance with Article 2224 of the French Civil Code.
Article 10 — Applicable Law and Disputes
These ToS are governed by French law, in accordance with Regulation (EC) No 593/2008 of 17 June 2008 (Rome I). However, in accordance with Article 6(2) of that Regulation, this choice may not deprive the consumer Customer of the protection afforded to them by the mandatory provisions of the law of the country in which they have their habitual residence. In the event of a dispute, the parties shall endeavour to find an amicable solution. Failing this, the Customer who qualifies as a consumer may bring proceedings, at their choice, before the court of the place where they were domiciled at the time of the conclusion of the contract or of the occurrence of the harmful event, or before one of the courts having territorial jurisdiction under the Code of Civil Procedure. The protective provisions of Regulation (EU) No 1215/2012 in favour of the consumer remain applicable.
